**Department Overview:**
The Legal department of the TD Bank Financial Group is comprised of corporate/commercial and litigation lawyers with varying areas of expertise tailored to meet the legal needs of the various business units of TD Bank Financial Group. The Legal Department is committed to delivering to its clients the highest level of expertise, service, responsiveness, and flexibility. Our lawyers identify emerging client opportunities, provide prompt and informed legal advice and produce tangible results that implement creative solutions.
The Account Recovery Services group within Legal Department supports the Account Recovery & Fraud Management Group providing dedicated mortgage enforcement services which are integral to the recovery of Bank funds on defaulted mortgages.
**Job Description/Accountabilities:**
As a member of the account recovery services team you will work in a fast paced legal environment delivering quality mortgage enforcement services to our client, the Account Recovery and Management Group. Your duties will include:
+ Preparation of various legal documentation
+ Preparation of correspondence and the handling of a variety of communications with customers, other Bank staff, outside law firms and agents including property managers.
+ Provide quality service and professionalism at every interaction
+ Prioritize and manage workflow to ensure quality and efficiency, meet deadlines and be flexible in adjusting to changing work priorities
+ Respond promptly and thoroughly to requests for information
+ Create/develop forms/tools & templates
+ Take initiative to identify and recommend improvements in job function
+ Use software programs and other departmental tools or equipment with ease, efficiency and provide appropriate documents/information that legal counsel team members require
+ Sundry administrative duties as required
**Specific Educational Requirements/Accreditations:**
+ Law Clerk designation is required
**Other Qualifications/Skills/Experience:**
+ Previous collections and/or mortgage enforcement experience gained in a law firm or financial institution is required
+ Sound knowledge of legal/litigation concepts, terminology and procedures is required.
+ Sound understanding of power of sale process including property management issues, tenancies, evictions, securement is preferred.
+ Real Estate experience (ability to handle sale of properties, title issues) is preferred.
+ This position requires you to have excellent verbal and written communication skills, above average comprehension ability, well organized and the ability to handle simultaneous tasks.
+ General computer literacy (MS Word, MS Internet Explorer), working knowledge of Bar-Ex is also required. Familiarity with Techcom (RPMS) system is an asset.
+ You must be well organized and able to independently manage your workload and meet timelines.
+ The successful candidate will be responsible for dealing with confidential matters with appropriate discretion.
+ Strong communication skills including a demonstrated ability to deal with customers whose accounts are in collection.
+ Above average reading, writing and comprehension ability.
+ You must be detail oriented.
+ Your drafting must be accurate.
+ You must be able to work cooperatively with other staff members and have the flexibility to take on any tasks assigned to meet Department needs.
+ You must be an enthusiastic team player continually striving for service excellence.

**DESCRIPTION:**
Reporting to the Legal Office Supervisor/Senior Manager of Legal Support, assists the Lawyers handling
P & C Insurance Legal Matters, representing TD Insurance or its Policyholders in civil litigation and no fault/accident benefits matters involving claims for monetary damages or compensation for personal injury or property damage.
**GENERAL ACCOUNTABILITIES:**
Reviews and analyzes new file assignments, organizes file contents, and prepares summary memoranda of medical, investigation and all documentary productions received. Updates/posts in electronic systems all relevant work completed on a file.
Prepares affidavit of documents for review by Lawyer and arranges and manages undertakings chart.
Organizes and prepares files for discovery/questioning.
Follows up on undertakings and production requests.
Prepares document briefs for expert reviews and drafts motions.
Other duties as instructed by the Lawyers, which may vary by jurisdiction.
Remains current with developments in the law; understands medical, scientific, construction, product liability, engineering issues and defences involved with such cases.
**JOB REQUIREMENTS** - **SKILLS AND KEY COMPETENCIES**
Education
+ Paralegal/Law Clerk diploma/certificate from a recognized educational institution or equivalent work experience at a reputable law firm or legal department.
Experience
+ 1-5 years paralegal/law clerk experience or equivalent.
+ Background in insurance defence litigation, including personal injury and accident benefit claims (preferred), and/or general litigation experience.
Knowledge
+ Knowledge of legal and court documents and procedures.
+ Knowledge of standard office equipment and word processing.
Special Abilities
+ Excellent oral and written communication.
+ Ability to communicate effectively with insured clients, claims representative and court/tribunal staff.
+ Excellent legal drafting skills and eye for detail.
+ Motivated self-starter with ability to work productively under pressure and deliver business results.
+ Strong interpersonal & client service skills; professional and positive demeanour.
+ Superior organization & priority setting skills, strong work ethic and ability to mutli-task.
